Terms and Conditions

September 7, 2026

Important notice: please read this first

These Terms and Conditions contain important provisions affecting your legal rights, including a mandatory binding arbitration clause, a waiver of your right to a jury trial, a class action waiver, and limitations on our liability. Please read them carefully before using this website or authorizing any work.

In these Terms, “Contractor”, “we”, “us” and “our” mean LOGI Infinity Services LLC. “Customer”, “you” and “your” mean the person or entity using this website or requesting or authorizing services. “Services” means all services, labor, and materials we provide.

This website and your requests

About our services

LOGI Infinity Services provides air conditioning and HVAC services for homes and businesses: system installation and replacement, repair, planned maintenance, indoor air quality, duct cleaning and sealing, smart thermostats, and commercial HVAC. We serve Cape Coral and the surrounding Southwest Florida area, including Lee, Collier, Sarasota and Charlotte counties.

Information on this website is general in nature. It does not replace an on-site assessment of your system by a licensed technician, and it is not a diagnosis of any particular system or condition.

Estimates, quotes, and prices shown online

Any figure shown on this website, given over the phone, produced by an online tool, or offered by our assistant is a preliminary reference only. A binding price is provided in writing after a technician inspects your system on site and confirms the scope of work, and it remains valid for the period stated in the written quote.

Prices published for maintenance plans are an exception: those are the current published prices for those plans and apply as described on the membership page. They do not include parts, repair work, or installation, which are quoted separately.

Availability of equipment, parts, and lead times can change without notice, and a quote may be revised if the scope of work changes or if conditions found on site differ from those assumed.

No contractor-customer relationship until agreed

Using this website, browsing its content, chatting with our assistant, or submitting a request does not create a contractor-customer relationship. That relationship begins only once we agree on the scope and you approve a written quote or work order with LOGI Infinity Services LLC.

Website requests, age, and authority

You must be at least 18 years old to submit a request through this website. Requests should be submitted by the property owner or by an authorized representative who confirms they have the authority to accept these Terms and to authorize work at the property. Section 12 explains what that authority means and what happens if it is disputed.

Scheduling and emergency support

Requests submitted through the website, the chat assistant, or by phone are requests only. They are not confirmed until our team contacts you and confirms a time.

We offer emergency support for urgent breakdowns and, during periods of high demand, we prioritize by urgency. Arrival windows are estimates, not guarantees, and priority scheduling for members means priority in the queue, not a guaranteed arrival day.

Communications, text messages, and our assistant

By providing your contact information, you consent to be contacted by phone, email, or text message regarding your requests and our services. Message and data rates may apply, message frequency varies, and you may opt out of text messages at any time by replying STOP or by telling us. Opting out of marketing messages does not stop messages that are necessary to carry out work you have requested.

Our website includes a virtual assistant that answers questions and can take a service request. It is an automated tool: it does not diagnose a system, it does not give binding prices for repairs or installations, and it does not replace an assessment by a licensed technician. A visit requested through the assistant is a request, and the office confirms the time.

Please do not share sensitive personal or financial information, such as Social Security numbers, bank or card numbers, or identity documents, through the website, the assistant, chat, email, or text message.

Intellectual property

All content on this website, including text, graphics, the LOGI Infinity Services name and logo, and design, is the property of LOGI Infinity Services LLC or its licensors and is protected by applicable laws. You may not reproduce, distribute, or use it without prior written permission.

Website disclaimer

The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, LOGI Infinity Services LLC is not liable for any damages arising from your use of, or inability to use, the website, or from any decision made in reliance on information provided here. Liability relating to work we perform is addressed in Section 24.

Work we perform

Authorization, acceptance, and entire agreement

By requesting or authorizing Services, whether electronically (for example, through our designated software platform), by signing on a mobile device, or verbally, you represent that you are the legal owner of the property where Services will be performed or an authorized agent of the owner, and you agree to be bound by these Terms in their entirety.

These Terms, together with any approved estimate, work order, or invoice we provide (the “Contract Documents”), constitute the sole and entire agreement between you and Contractor, superseding all prior or contemporaneous understandings, agreements, negotiations, representations, and warranties, both written and oral.

Representation of authority and personal guarantee

If you are authorizing Services on behalf of the property owner, for example as a property manager, tenant, facility manager, or other agent, you represent and warrant that you have full and complete legal authority to enter into this agreement and to bind the property owner to its terms.

You further agree that if the property owner disputes your authority and refuses to pay for the Services, you will be held personally, jointly, and severally liable for the full amount due. You agree to indemnify and hold Contractor harmless from any claims, losses, damages, and expenses, including attorneys’ fees, arising from the property owner’s claim that you lacked the authority to authorize the Services.

Scope of services and change orders

Contractor shall perform only the Services described in the approved Contract Documents. Any deviation, addition, or modification to the scope of work (a “Change Order”) must be authorized by you in writing, including by electronic approval through our designated software platform, before the additional work is performed. Change Orders may result in additional charges and are governed by these Terms.

Customer obligations

You agree to provide a safe and unobstructed work environment, including: clear and safe access to all work areas; securing pets away from the work area; ensuring a responsible adult with authority to make decisions is present during the Services; and providing necessary utilities such as power and water.

You are responsible for informing Contractor of any known pre-existing conditions, including concealed plumbing, wiring, or hazardous materials. Contractor is not liable for delays or additional costs resulting from your failure to meet these obligations.

Licensing, permits, and code

LOGI Infinity Services LLC holds Florida mechanical contractor license CMC1251760 and carries insurance. Work that requires a permit is permitted and inspected as the Florida Building Code and the local jurisdiction require. Permit and inspection fees are charged as set out in the Contract Documents, and scheduling of inspections depends on the local jurisdiction and is outside our control.

Pricing and payment terms

Payment is due in full upon completion of the Services unless otherwise stated in writing in the Contract Documents. Any balance unpaid after thirty (30) days is considered delinquent and shall accrue interest at a rate of 1.5% per month (18% annually), or the maximum rate permitted by Florida law, whichever is less. A late fee of $50 may also be assessed on any delinquent balance.

You agree to pay all costs incurred by Contractor in collecting any delinquent amounts, including reasonable attorneys’ fees, court costs, and collection agency fees.

Cancellations, rescheduling, and access

If you need to cancel or reschedule a visit, please tell us as early as you can. If our technician cannot carry out the work because nobody is present, because access to the equipment is blocked, or because the site is unsafe, a trip or diagnostic charge may apply as set out in the Contract Documents.

This section does not limit your cancellation rights under Section 25.

Limited workmanship warranty

Contractor warrants its labor against defects in workmanship for the following periods from the date of substantial completion: new equipment installations, one (1) year; service or repair work, thirty (30) days; condensate drain cleaning or clearing, thirty (30) days.

This is the sole and exclusive warranty provided by Contractor. To make a warranty claim, you must provide written notice to Contractor within the applicable warranty period. Contractor’s sole obligation shall be to, at its option, repair or replace the defective workmanship.

This warranty is void if you or any unauthorized third party attempts to modify or repair the work performed by Contractor. It does not cover equipment, parts, or materials, which are covered exclusively by manufacturer warranties, if any.

Manufacturer warranties

All equipment, parts, and components are sold subject to the manufacturer’s warranty only. Contractor does not provide any separate or additional warranty for equipment or parts. Any manufacturer warranties are assigned to you to the fullest extent permitted.

Contractor will reasonably assist you in processing valid manufacturer warranty claims; however, Contractor is not the warrantor and does not guarantee approval of any claim. Manufacturer warranties generally require correct registration of the equipment and documented annual maintenance, and a claim may be refused if those conditions are not met.

Third-party extended warranties

If you choose to purchase an extended warranty or service contract from a third-party company (a “Third-Party Warranty”) through us, you acknowledge and agree that the Third-Party Warranty is a separate contract between you and that provider. Contractor is not the warrantor and acts only as a facilitator or sales agent.

Your sole and exclusive remedy for any claim, denial, or issue arising from the Third-Party Warranty lies with the third-party provider, not with Contractor. Contractor makes no representations or guarantees regarding its coverage, the provider’s financial stability, or the provider’s willingness or ability to approve claims or perform services in a timely manner.

You acknowledge that you have been provided with, have read, and agree to the terms and conditions of the Third-Party Warranty agreement provided by that company, and that Contractor may receive compensation from the provider for facilitating the sale.

Financing through independent lenders

Financing is offered through independent lending partners. Contractor presents the option, hands over the application, and explains the scope of the work being financed. Approval or denial, and the rate, term, and conditions, are set by the lender, not by Contractor. We cannot promise an approval and we do not quote a rate or a monthly payment.

Any credit application is governed by that provider’s own terms and privacy policy, and is submitted to the provider directly. We do not collect financial details, Social Security numbers, or bank information through this website or our assistant.

Disclaimer of all other warranties

The limited workmanship warranty above is the only warranty provided by Contractor. To the fullest extent permitted by Florida law, Contractor expressly disclaims all other warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. All Services, equipment, and materials are provided on an “as is” and “with all faults” basis. There are no warranties which extend beyond the description on the face hereof.

Limitation of liability and waiver of certain damages

In no event shall Contractor’s total aggregate liability arising from or relating to these Terms or the Services exceed the total amount paid by you to Contractor for the specific Services giving rise to the claim.

Neither party shall be liable to the other for any indirect, special, incidental, consequential, punitive, or exemplary damages, regardless of the legal theory asserted. This waiver includes but is not limited to damages for lost profits, business interruption, loss of use of property, damage to property other than the equipment being serviced, costs of temporary housing, spoiled food, or any other economic loss.

This limitation of liability is a material part of the bargain between the parties and shall apply even if any remedy fails of its essential purpose. Nothing in these Terms limits any liability that cannot be limited under Florida law.

Hazardous materials and concealed conditions

Contractor is not responsible for the detection, abatement, or removal of hazardous materials, including but not limited to asbestos, lead, or mold. If such materials are discovered, work will cease and you will be responsible for all costs associated with their professional remediation.

If concealed or unknown conditions are discovered, such as non-compliant wiring or structural defects, and additional work is required, that work will be treated as a Change Order.

Your right to cancel a sale made at your home

If you agreed to the Services at your home rather than at our place of business, Florida law gives you the right to cancel that agreement, without penalty or obligation, before midnight of the third business day after the date of the transaction. To cancel, notify us in writing at the address shown in your Contract Documents, or at office@logiinfinity.com, within that period.

This right does not apply to work you ask us to begin immediately as a bona fide emergency, where you have given us a separate written statement describing the emergency and waiving the right to cancel, to the extent Florida law permits.

Florida Homeowners’ Construction Recovery Fund

Payment may be available from the Florida Homeowners’ Construction Recovery Fund if you lose money on a project performed under contract, where the loss results from specified violations of Florida law by a state-licensed contractor. For information about the Recovery Fund and filing a claim, contact the Florida Construction Industry Licensing Board at: Florida Department of Business and Professional Regulation, 2601 Blair Stone Road, Tallahassee, FL 32399-1039, telephone 850-487-1395.

Florida construction defects notice (Chapter 558)

Pursuant to Florida Statutes, Chapter 558, any claim for an alleged construction defect must be preceded by a formal pre-suit notice process. Before you may file any lawsuit, arbitration, or other legal action against Contractor, you must first provide Contractor with a written notice of claim that complies with Chapter 558.

The notice must be served via certified mail or another verifiable delivery method to our registered agent and must: (a) refer to Chapter 558; (b) describe in reasonable detail the nature of each alleged defect; and (c) identify the location of each defect and the damage or loss resulting from it. Upon receipt of a valid notice, Contractor has statutory rights to inspect the property and the opportunity to resolve the claim by making an offer to repair, settle, or dispute the claim. Failure to comply with this mandatory pre-suit process will result in a stay of any legal action you file until you have complied.

Florida construction lien law notice

According to Florida’s Construction Lien Law (sections 713.001-713.37, Florida Statutes), those who work on your property or provide materials and services and are not paid in full have a right to enforce their claim for payment against your property. This claim is known as a construction lien.

If your contractor or a subcontractor fails to pay subcontractors, sub-subcontractors, or material suppliers, those people who are owed money may look to your property for payment, even if you have already paid your contractor in full. If you fail to pay your contractor, your contractor may also have a lien on your property. This means if a lien is filed your property could be sold against your will to pay for labor, materials, or other services that your contractor or a subcontractor may have failed to pay.

Disputes and general provisions

Mandatory binding arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Lee County, Florida, before one arbitrator.

The arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. This clause does not preclude either party from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction, and it does not prevent either party from bringing an individual claim in small claims court.

Arbitration and the notice requirements in the Chapter 558 section above apply together: the pre-suit notice must be given before arbitration is commenced.

Waiver of jury trial and class action waiver

By accepting these Terms, you and Contractor acknowledge that you are giving up the right to a trial by jury. You and Contractor further agree that any dispute resolution proceedings, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

Governing law, venue, and attorneys’ fees

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. The exclusive venue for any arbitration or court proceeding permitted under these Terms shall be in Lee County, Florida.

In any legal action or arbitration arising from these Terms, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs from the non-prevailing party.

Miscellaneous provisions

Force majeure: Contractor is not liable for delays or failure to perform due to events beyond its reasonable control, including acts of God, hurricanes and severe weather, pandemics, material shortages, labor strikes, or governmental actions.

Severability: if any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

Assignment: you may not assign your rights or obligations under these Terms without our prior written consent.

No third-party beneficiaries: these Terms are for the sole benefit of the parties and their respective successors and permitted assigns, and confer no right, benefit, or remedy on any other person or entity.

Survival: provisions which by their nature should apply beyond their terms remain in force after any termination or expiration, including warranty disclaimers, limitations of liability, and dispute resolution clauses.

Notices: all legal notices required under these Terms shall be in writing and sent to the addresses listed in the Contract Documents via certified mail or a recognized overnight courier.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and your continued use of the website constitutes acceptance of the updated Terms. The Terms that govern work we perform for you are the ones in effect on the date you approve the Contract Documents for that work.
